The defendant, Fiske, was convicted under the Kansas Criminal Syndicalism Act, which criminalized advocating for crime or violence as a means of achieving industrial or political change. The charge stemmed from Fiske soliciting memberships in the Industrial Workers of the World (IWW). The state’s sole evidence that the IWW advocated criminal syndicalism was the preamble to its constitution. The preamble stated that the working and employing classes have nothing in common and that a struggle must continue until workers “take possession of the earth, and the machinery of production and abolish the wage system.” The text did not explicitly advocate for violence or any unlawful methods to achieve these ends. Fiske testified that he did not advocate for criminal syndicalism and that the IWW sought to achieve its goals peacefully.
