ExxonMobil subsidiaries and Saudi Basic Industries Corp. (SABIC) were involved in joint ventures. A dispute arose over royalty charges. SABIC filed a declaratory judgment action in Delaware state court in July 2000. Approximately two weeks later, ExxonMobil sued SABIC in federal district court in New Jersey, alleging overcharges. In January 2002, ExxonMobil asserted counterclaims in the Delaware action identical to its federal claims. The Delaware state court entered judgment on a jury verdict exceeding $400 million in favor of ExxonMobil in March 2003. SABIC appealed this state judgment. Subsequently, the Third Circuit Court of Appeals, hearing an interlocutory appeal in the federal case, sua sponte raised the Rooker-Feldman doctrine.
