Joseph and Iris Kievernagel were married and undergoing in vitro fertilization (IVF). As part of the process, Joseph provided a sperm sample for cryopreservation. He signed an agreement with the fertility center that designated the sperm as his sole and separate property and gave him exclusive authority over its disposition. The agreement presented two options for the sperm upon his death: donate it to his wife or discard it. The box next to “discard the sperm sample” was checked, and Joseph initialed it. Iris completed the form and signed an acknowledgment. After Joseph died unexpectedly, Iris, as administrator of his estate, petitioned the probate court to obtain the frozen sperm for posthumous conception. Joseph’s parents objected, citing the agreement as evidence of their son’s intent not to father a child after his death. The probate court found that Joseph’s intent was for the sperm to be discarded and denied Iris’s petition. Iris appealed.
