Over several years, Direct Sales sold Dr. Tate, a physician in a small rural town, vast quantities of morphine sulphate. The volume of these sales far exceeded any possible legitimate medical use; in the last six months of 1939, shipments were sufficient for 400 average doses per day. Direct Sales actively solicited these large orders through catalogues offering substantial discounts for bulk purchases, a practice it continued even after being warned by the Bureau of Narcotics that its sales to Dr. Tate were excessive and that it was a known source for physicians convicted of narcotics violations. On one occasion, the company advised Dr. Tate to split a large order into two separate forms and enclosed a sticker encouraging him to anticipate future needs. The company’s profits from these sales constituted its “stake” in Dr. Tate’s illegal enterprise of distributing the drugs to addicts.
