Plaintiff D.C. Comics, Inc. created the Superman character in 1938 and, since 1940, has used the name “Daily Planet” for the fictional newspaper within the Superman universe. Defendants began publishing an underground newspaper in 1969, eventually naming it “The Daily Planet.” Their publication was sporadic, primarily local, and ceased in 1973 due to financial issues. They obtained a federal trademark registration in 1970 but allowed it to lapse, leading to its cancellation in 1976. Defendants’ newspaper made numerous explicit references to the Superman story, including using the term “Metropolis,” featuring drawings of Superman, and using a masthead that was an exact replica of the one from the comics.
