Plaintiff CompuServe, a commercial online service provider, owned and operated a proprietary computer network. Defendants Cyber Promotions, Inc. and its president sent large volumes of unsolicited commercial email (“spam”) to CompuServe’s subscribers. These emails burdened CompuServe’s computer equipment, consuming finite processing and storage capacity. The spam generated numerous subscriber complaints, damaged CompuServe’s business reputation and goodwill, and caused some subscribers to terminate their accounts. CompuServe explicitly notified Defendants that they were prohibited from using its equipment and demanded they cease sending the emails. CompuServe also implemented technical measures to block the spam. In response, Defendants continued sending the emails and deliberately circumvented the blocks by falsifying the point-of-origin information in the email headers, thereby concealing the true source of the messages. CompuServe sought a preliminary injunction to stop the transmissions, asserting a claim for trespass to chattels.
