Attorney William D. Baker entered into a referral arrangement with Rex Voegtlin, a non-lawyer financial planner who marketed living trusts through public seminars. Following the seminars, Voegtlin held individual consultations with potential clients, analyzed their financial information, and advised them on the necessity and structure of a living trust and other estate planning documents. After determining the client’s needs, Voegtlin would refer the client to an attorney, overwhelmingly recommending Baker. Voegtlin often called Baker during the consultation, explained the plan, and then had the client speak with Baker. Baker would then draft the documents based on Voegtlin’s instructions. In many cases, the final documents were executed in Voegtlin’s office, with Voegtlin present. Baker provided Voegtlin with sample legal forms, including a letter stating that Voegtlin had recommended the estate plan. Over a two-year period, Baker accepted approximately 100 such referrals and admitted that he never once advised a referred client that a living trust was inappropriate for their situation. The Grievance Commission found Baker had aided the unauthorized practice of law (UPL) and engaged in a conflict of interest.
