A group of truck drivers (Respondents) were members of the Chauffeurs, Teamsters and Helpers Local No. 391 (Union). Following a change in operations by their employer, McLean Trucking Company, a seniority dispute arose between Respondents and other union members. Respondents filed several grievances, alleging the employer breached the collective-bargaining agreement (CBA) and that the Union failed to properly represent them. After the Union declined to pursue their final grievance, Respondents filed a “hybrid” suit in federal court against both McLean for breach of the CBA under § 301 of the Labor Management Relations Act and the Union for breach of its duty of fair representation (DFR). McLean subsequently filed for bankruptcy, and all claims against it, including requests for injunctive relief, were dismissed. The remaining action was against the Union for compensatory damages, specifically lost wages and benefits (backpay). Respondents demanded a jury trial, which the Union moved to strike. The District Court denied the motion, and the Fourth Circuit affirmed, holding the Seventh Amendment applied.
