Case Brief Summary & Legal Analysis
tl;dr: An employer fired an at-will employee for volunteering at an AIDS foundation due to his fear of the disease. The court affirmed summary judgment for the employer, finding the termination did not violate public policy or constitute handicap discrimination under then-existing Texas law.
Legal Significance: This case illustrates the Texas judiciary’s historical reluctance to expand common law public policy exceptions to the employment-at-will doctrine and highlights a narrow, pre-ADA statutory interpretation of “handicap” that does not include perceived disabilities or association with the disabled.

Case Facts & Court Holding
Key Facts & Case Background
Plaintiff Brunner was an at-will employee at Apollo Paint & Body, a partnership owned by Farouk and Rima Al Attar. Brunner informed her employer, Farouk Al Attar, that she was volunteering at the AIDS Foundation during her personal time. Al Attar expressed fear that Brunner would contract AIDS and spread it to him, his family, and other employees. Brunner assured him this was not possible through casual contact and that her volunteer work would not interfere with her job. Al Attar insisted that she could not continue both her job and her volunteer work, stating he did not want to place his workplace in jeopardy. He asked her to resign, and when she refused, he terminated her employment. Brunner explicitly stated that she did not have AIDS or the human immunodeficiency virus. She filed suit alleging wrongful termination in violation of public policy and discrimination because of a handicap. The trial court granted summary judgment for the employer.
