The Hensels (sellers) contracted to sell their home to the Billmans (buyers) for $54,000. The contract included a condition precedent requiring the buyers to secure a conventional mortgage for at least $35,000 within thirty days. Mr. Billman informally consulted one bank and was told he needed to demonstrate funds for the $19,000 difference between the purchase price and the $35,000 mortgage. He determined he was $6,500 short. Subsequently, after his father expressed reservations about the property, Mr. Billman informed the Hensels the deal was off, citing his parents’ refusal to lend him $5,000. When the Hensels offered to reduce the price by $5,000, Billman declined, stating he still needed an additional $1,500. The Billmans made no formal loan application to any institution and stopped payment on their $1,000 earnest money check. The Hensels sued to recover the earnest money, and the trial court found for the Hensels.
