Patricia Murray Fewell (Settlor) created an irrevocable spendthrift trust, naming Republic National Bank of Dallas as Trustee. The trust was established for the “use and benefit of herself and of her children.” Under the trust terms, the Settlor was entitled to all net income for her lifetime. The trustee also had discretion to pay the Settlor or her descendants principal if their income was insufficient for reasonable support, comfort, health, and education. Furthermore, the Settlor retained a general testamentary power of appointment over the remaining principal and undistributed income. Bank of Dallas, a judgment creditor of the Fewells, sought to garnish the trust’s income and corpus to satisfy a debt. The trial court allowed garnishment of the income but denied garnishment of the corpus. Both parties appealed.
