B & K Rentals and Sales Co. (B & K) sued Universal Leaf Tobacco Co. (Universal) after a fire in Universal’s warehouse destroyed B & K’s property. B & K sought to prove Universal’s negligence through the testimony of a fire investigator, Lt. Klasmeier. The investigator’s opinion about the fire’s cause was based almost exclusively on statements made by a Universal employee, Grimes, to another investigator at the scene. Grimes stated that another employee, Johnson, had been using an acetylene torch shortly before the fire started and that he believed the torch caused the fire. Universal objected to the admission of Grimes’s statements, either directly or through the investigator’s report and testimony, as inadmissible hearsay. The trial court agreed, finding the statements did not qualify as vicarious admissions because Grimes lacked “speaking authority” to make statements on Universal’s behalf, and the statements were not part of the “res gestae.” The trial court ultimately entered a judgment notwithstanding the verdict for Universal. The central issue on appeal was the proper standard for admitting an agent’s out-of-court statement against a principal party.
