Appellants hired Ohio lawyers (Sipe and Smith) for a personal injury claim arising from an accident in West Virginia. After voluntarily dismissing a timely suit in Ohio, the Ohio lawyers decided to refile in federal court in West Virginia, erroneously believing Ohio’s savings statute would apply. Days before the Ohio refiling deadline, they retained Lantz, a West Virginia attorney, to act as local counsel. Lantz was given a “thumbnail procedural history” and asked to review the complaint’s form. He was not asked to opine on the choice of forum or the statute of limitations, which the Ohio lawyers had already researched. There was no agreement for Lantz to share in the profits or losses; he expected to be compensated for his services, possibly a flat fee. The Ohio lawyers made the strategic decision to file in West Virginia. The federal court dismissed the suit as time-barred under West Virginia law, which does not save voluntarily dismissed actions. The Armors then sued Lantz for legal malpractice.
