The City of Los Angeles enacted an ordinance requiring hotels with 150 or more rooms to pay workers a minimum wage of $15.37 per hour, significantly higher than the state minimum wage. The ordinance did not permit offsets for tips or benefits. A key provision allowed the ordinance’s requirements to be waived through a ‘bona fide collective bargaining agreement’ (CBA) if the waiver was set forth in ‘clear and unambiguous terms.’ The ordinance also stated that unilateral implementation of employment terms by either party would not constitute a waiver. Plaintiff hotel associations, representing union and non-union hotels, sought a preliminary injunction to block the ordinance. They argued that the high wage, combined with the CBA-exclusive waiver, created coercive economic pressure on non-union hotels to unionize in order to negotiate a lower, more competitive wage. Plaintiffs contended this scheme impermissibly aided UNITE HERE Local 11, the only hotel workers’ union in the area, by giving it an economic weapon it would otherwise have to bargain for, thereby disrupting the balance of power intended by the National Labor Relations Act (NLRA).
