An attorney, Scott DeVries, represented Aerojet in complex insurance litigation. DeVries’s client gave him a packet of documents that had been inadvertently sent to Aerojet’s insurance broker by opposing counsel’s client. The documents were from the opposing law firm, Bronson, and contained privileged attorney-client communications and work product. One memorandum described an interview with a potential witness, Warren Michaels, and assessed his value to the case. DeVries was without fault in his initial receipt of the documents. He reviewed them, learned of Michaels’s existence, and subsequently deposed him. DeVries did not immediately notify opposing counsel that he had received the documents, which he later destroyed during a routine office cleaning. The trial court found DeVries’s failure to promptly notify opposing counsel, his use of the information, and his destruction of the documents constituted unethical and bad-faith conduct. It sanctioned DeVries’s law firm for the opposing parties’ attorney’s fees incurred in investigating the disclosure and bringing the sanctions motion, and also precluded Michaels from testifying.
